Search Warrant Successfully Cancelled

Civil Application 208/2021 - Judgement Dated 06/12/2021

The Supreme Court held, in agreement with the applicant, that the search warrant issued by the District Court of Paphos had to be cancelled, as the Police had withheld relevant and crucial information from the District Judge in their application.

Additionally, the Supreme Court held that the facts that were put before the District Judge were incapable of establishing reasonable suspicion that any crime had been committed within the jurisdiction of the Cypriot courts. The investigation concerned internet services the provision of which were illegal within Cyprus at the material time.
